PROMOTION DESCRIPTION:
The Xmas Global Sweepstake - 2022 Be With AORUS (the "Sweepstake") is hosted by GIGA-BYTE TECHNOLOGY CO., LTD, No.6, Baoqiang Rd., Xindian Dist., New Taipei City 231, Taiwan (the "Host"). By participating in the Sweepstake, each entrant unconditionally accepts and agrees to comply with and abide by these Terms and Conditions, the Rules, and the decisions of the Host, which shall be final and binding in all respects. The Host is responsible for the collection, submission or processing of the entries and the overall administration of the Sweepstake. In case of any questions, comments or problems related to the Sweepstake, the Entrants should approach solely the Host. The Host may be reached by email at esupport.gigabyte.com during the Promotion Period.
ELIGIBILITY:
The Sweepstake is open to legal residents 18 years of age or older of all countries/localities except Italy, Portugal, North Korea, Syria, Iran, Sudan, Cuba and Venezuela, Quebec Rhode Island, Florida, and New York (the "Entrant").
The Host, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the "Promotion Entities"), are not eligible to enter the Sweepstake or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. "Household Members" shall mean those people who share the same residence for at least three months a year. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Sweepstake is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law. GIGABYTE reserves the right to cancel or withdraw all awards and prize entitlements if any content submitted by the entrants is not their own original creation.

Prizes cannot be transferred, redeemed for cash or substituted by the winners. The Host reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The prizes are not transferable or eligible for a standard manufacturer warranty. The ARV of the prize represents the Host's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. The Host makes no representation or warranty concerning the appearance, safety, or performance of any prize awarded. Restrictions, conditions, and limitations may apply. The Host will not replace any lost or stolen prize items.

HOW TO ENTER:
The Sweepstakes is open for Entries during the promotion period from GIGABYTE AERO XMAS Event (the “Phase 1”): 14th December 2022 to 11:59 PM 10th January 2023 (UTC+8), GIGABYTE NEW YEAR Event(the “Phase 2”): 0:00 AM 29rd Dec 2022 to 11:59 PM 10th JAN, 2023 (UTC+8). Entries must be submitted online by following the instructions which can be found on the website https://www.aorus.com/event/be-with-aorus or robotic entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the entrant. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All entries must be posted by the end of the promotion period to be eligible for participation. The Host's database clock will be the official timekeeper for these Sweepstakes. By entering these Sweepstakes, the Entrant agrees that his/her Entry will be bound by these Terms and Conditions.
WINNER SELECTION:
The Winners will be determined on 18th January 2023.
The Winners of the Sweepstakes will be determined by a random draw by GIGABYTE from among all the eligible Entries received throughout the Promotion Period.
WINNER NOTIFICATION:
The Winners will be announced on the social media accounts of AORUS (Facebook, Twitter or Instagram) and on the Sweepstake landing page https://www.aorus.com/event/be-with-aorus. They will also be notified by private message or email provided in the Entry Information approximately 7 days after the winner announcement. The potential winner must accept the prize by email as directed by the Host within 2 weeks of notification. The Host is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or the winner’s failure to adequately monitor any email account.
Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively "the Prize Claim Documents"). No substitution or transfer of a prize is permitted except by the Host.
The winner agrees to the use of his/her name, image and entry in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with the current data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
Entry into the Sweepstake will be deemed as acceptance of these terms and conditions.
The Host (GIGABYTE) shall have the right, at its sole discretion and at any time, to change or modify these terms and conditions. Such change(s) shall be effective immediately upon posting on this webpage.

If the dispute cannot be resolved through mediation, they shall be free to pursue other legal options.
Nothing in these Terms and Conditions, including this Governing Law clause, affects your right to benefit from any mandatory provisions of the law of the state/ country in which you are resident.
