PROMOTION DESCRIPTION:
The Sweepstakes is hosted by GIGA-BYTE TECHNOLOGY CO., LTD, No.6, Baoqiang Rd., Xindian Dist., New Taipei City 231, Taiwan (the "Host"). By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Terms and Conditions, and the decisions of the Host, which shall be final and binding in all respects. The Host is responsible for the collection, submission or processing of the entries and the overall administration of the Sweepstakes. In case of any questions, comments or problems related to the Sweepstakes, the Entrants should approach solely the Host. The Host may be reached by email at esupport.gigabyte.com during the Promotion Period.
ELIGIBILITY:
The Sweepstakes is open only to legal residents of Taiwan 18 years of age or older (the "Entrant"). Residents from other countries may enter through the “Global Entrants” portal if they meet the eligibility requirements there.
The Host, and its respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the "Promotion Entities"), are not eligible to enter the Sweepstakes or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. "Household Members" shall mean those people who share the same residence for at least three months a year. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law. GIGABYTE reserves the right to cancel or withdraw all awards and prize entitlements if any content submitted by the entrants is not their own original creation.

Prizes cannot be transferred, redeemed for cash or substituted by the winners. The Host reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Terms and Conditions is unavailable or cannot be awarded, in whole or in part, for any reason. The prizes are not transferable or eligible for standard manufacturer warranty. The ARV of the prize represents the Host's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. The Host makes no representation or warranty concerning the appearance, safety, or performance of any prize awarded. Restrictions, conditions, and limitations may apply. The Host will not replace any lost or stolen prize items.

The Sweepstakes is open for entries during the promotion period from GIGABYTE AERO 16 Color Relay Challenge (the “Phase 1”) : 0:00 AM 3rd August, 2022 to 11:59 PM 17th August, 2022 (UTC+8). GIGABYTE AERO 16 Creativity Relay Challenge (the “Phase 2”): 0:00 AM 23rd Aug, 2022 to 11:59 PM 8th Sep, 2022 (UTC+8) ), (“collectively, the “Promotion Period”). Internet entry must be made by the entrant. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. The potential winner must accept the prize by email as directed by the Host within 2 weeks of notification. The Host is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or the winner’s failure to adequately monitor any email account.

The winner agrees to the use of his/her name, image and entry in any publicity material. LIMITATION OF LIABILITY:

GOVERNING LAW; DISPUTE RESOLUTION:

You agree to the personal jurisdiction by the courts of Taipei, and waive any objection to such jurisdiction. If any dispute arises from the use of these services, parties may make use of mediation. If the dispute cannot be resolved through mediation, they shall be free to pursue other legal options.
Nothing in these Terms and Conditions, including this Governing Law clause, affects your right to benefit from any mandatory provisions of the law of the state/ country in which you are resident.
