3. Agreement to Rules

By entering the Sweepstakes, the contestant (“You” or “Entrant”) agrees to comply with and abide by these Official Rules and the decisions of the Sponsor, and represents and warrants that they meet all eligibility requirements.
You agree to accept the Sponsor’s decisions as final and binding as they relate to the Sweepstakes. Entrants should look solely to the Sponsor with any questions, comments, or issues related to the Sweepstakes.

If an Entrant uses fraudulent methods or otherwise attempts to circumvent the rules of the Sweepstakes, their submission may be disqualified at the sole discretion of the Sponsor.

6. Prize

One (1) Winner will receive:
One (1) one-of-a-kind custom modded Resident Evil PC featuring premium GIGABYTE/AORUS hardware and custom Resident Evil-themed design elements created in connection with the “Evil Season Is Here” campaign.

The final specifications, configuration, appearance, and details of the prize shall be determined solely by the Sponsor.
No cash or other prize substitution shall be permitted except at the Sponsor’s discretion. The prize is non-transferable. Substitution, transfer, assignment of the prize to another person, or request for the cash equivalent of the prize by the Winner is not permitted.

Any prize-related expenses not expressly included in the prize description, including any applicable federal, state, provincial, territorial, and/or local taxes, shall be the sole responsibility of the Winner.
Where permitted by law, acceptance of the prize constitutes permission for the Sponsor to use the Winner’s name, likeness, and eligible entry content for advertising, promotional, and publicity purposes without further compensation.

7. Odds of Winning

The odds of winning depend on the total number of eligible entries received during the Entry Period.

8. Winner Selection and Notification

The Winner will be selected by random drawing under the supervision of the Sponsor.
The Winner is expected to be announced on or around November 17, 2026.
The potential Winner will be notified using the contact information provided with their Sweepstakes entry within seven (7) days of Winner selection.

The Sponsor shall have no liability for a potential Winner’s failure to receive notification due to spam or junk email filters, security settings, incorrect contact information, or otherwise non-functioning contact information.

If a potential Winner cannot be contacted, is found to be ineligible, fails to claim the prize within seventy-two (72) hours / three (3) days from the time the award notification was sent, or fails to timely return any completed and executed declaration, release, verification, or other documentation required by the Sponsor, the prize may be forfeited and an alternate potential Winner may be selected.

For a potential Winner who is a resident of Canada, the Sponsor may require the potential Winner to correctly answer, without assistance, a time-limited mathematical skill-testing question before being confirmed as the Winner.
Receipt of the prize offered in the Sweepstakes is conditioned upon compliance with these Official Rules and all applicable federal, state, provincial, territorial, and local laws and regulations.

Any violation of these Official Rules by the Winner may result in disqualification and termination of all privileges associated with being a Winner.

9. Rights Granted by the Entrant

By submitting content in connection with the Sweepstakes, including but not limited to photographs, videos, screenshots, text, comments, or other materials, You understand and agree that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns shall have the right, where permitted by law, to print, publish, broadcast, reproduce, distribute, display, and use such content in any media now known or later developed for news, publicity, information, advertising, public relations, promotional, and related purposes without further compensation, notice, review, or consent.
By submitting content, You represent and warrant that the entry is your original work or that you possess all necessary rights to submit and authorize use of the content, and that the content does not violate any third party’s proprietary or intellectual property rights.

If an entry infringes upon the intellectual property or proprietary rights of another party, the Entrant may be disqualified at the sole discretion of the Sponsor.

You agree to indemnify, defend, and hold harmless AORUS (GIGABYTE) from and against any suit, proceeding, claim, liability, loss, damage, cost, or expense that AORUS (GIGABYTE) may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s rights.

10. Terms and Conditions

The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend, or suspend the Sweepstakes should fraud, virus, bug, unauthorized human intervention, technical failure, or any other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes.
In such cases, the Sponsor may select a Winner from eligible entries received before and/or after any action taken by the Sponsor, as appropriate and permitted by law.

The Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process, operation of the Sweepstakes, campaign website, Gleam widget, or any associated platform, or who otherwise violates these Official Rules.

The Sponsor reserves the right to maintain the integrity of the Sweepstakes and to void entries for any reason, including, but not limited to, multiple entries from the same Entrant exceeding applicable entry limits, the use of multiple accounts or identities to circumvent entry requirements, or the use of bots, macros, scripts, automated systems, or other technical means of entering.

Any attempt by an Entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may constitute a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies to the fullest extent permitted by law.

11. Limitation of Liability

By entering the Sweepstakes, You agree, to the fullest extent permitted by applicable law, to release and hold harmless AORUS (GIGABYTE) and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur directly or indirectly, whether caused by negligence or otherwise, from:

(i) participation in the Sweepstakes and/or acceptance, possession, use, or misuse of the prize or any portion thereof;
(ii) unauthorized human intervention in any portion of the Sweepstakes;

(iv) technical errors or malfunctions of any kind, including but not limited to computers, cables, networks, hardware, software, or other equipment;
(v) unavailable or inaccessible Internet, telephone, communication, or transmission services;
(vi) printing or administrative errors; or
(vii) lost, late, misdirected, incomplete, or undeliverable communications.
Nothing in these Official Rules shall exclude or limit any rights or remedies that cannot legally be excluded or limited under applicable law.

12. Disputes

To the fullest extent permitted by applicable law, the Sweepstakes and these Official Rules shall be governed by applicable laws of the United States, without regard to conflict-of-law principles.

By participating in the Sweepstakes, You agree that any disputes that cannot be resolved between the parties, and any causes of action arising out of or connected with the Sweepstakes, shall be resolved individually and without resort to any form of class action, to the extent permitted by applicable law.

Except where prohibited by applicable law, under no circumstances shall an Entrant be permitted to obtain awards for punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than actual out-of-pocket expenses directly associated with entering the Sweepstakes.

Entrants further waive any rights to have damages multiplied or increased, except where such waiver is prohibited by applicable law.

Nothing in this section is intended to limit any rights or protections that cannot be waived under applicable Canadian federal, provincial, or territorial law.
